Atlas Equine Cranial Massager – Terms and Conditions

By purchasing, using, or interacting with the Atlas Equine Cranial Massager (the “Product”), you agree to the following Terms and Conditions. If you do not accept these Terms, do not use the Product.

Atlas Equine Cranial Massager is not liable for any accidents, injuries, or damages resulting from misuse or failure to follow instructions. By using the Product, you accept full responsibility for its use and any outcomes related to it.

2. Limitation of Liability

To the maximum extent permitted by law, Atlas Equine Cranial Massager and its affiliates, employees, agents, suppliers, and distributors shall not be held liable for any loss, injury, or damage resulting from the use or misuse of the Product, including but not limited to:

  • Injuries to animals, persons, or property;

  • Damage resulting from incorrect handling or failure to maintain the Product;

  • Consequences of unauthorized modifications or repairs.

This limitation applies globally, except where restricted by law.

3. No Warranty for Injuries or Damages

The Product is sold "as is" without any express or implied warranties, including fitness for a particular purpose or merchantability.

Atlas Equine Cranial Massager is not responsible for any injuries or damages caused by accidents, improper handling, or deviation from the provided instructions.

Warranty does not cover:

  • Unauthorized repairs or modifications;

  • Wear and tear or environmental effects.

4. Indemnification

You agree to indemnify and hold harmless Atlas Equine Cranial Massager and its affiliates from any claims, losses, damages, liabilities, or expenses arising from:

  • Any injury or damage caused by the Product;

  • Legal claims resulting from a breach of these Terms or failure to follow instructions.

5. Health and Safety Precautions

  • Consult a veterinarian before using the Product, particularly if the horse has any existing injuries or health conditions.

  • Discontinue use immediately if the horse shows signs of pain, discomfort, or distress, and seek veterinary advice.

  • The Product is intended for use on healthy horses only. Atlas Equine Cranial Massager disclaims responsibility for any harm caused by inappropriate use.

6. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of New Zealand.

Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts in New Zealand, unless otherwise required by applicable law.

7. International Use

If using the Product outside New Zealand, you are responsible for complying with all applicable local laws regarding usage, importation, and safety.

Atlas Equine Cranial Massager makes no guarantees regarding legal compliance in other jurisdictions.

8. Warranty and Returns

To initiate a warranty claim, please return the Product to the original place of purchase or contact our support team at info@atlasequinemassager.com. Claims must be accompanied by a valid proof of purchase (receipt or invoice).

9. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Updates will be posted on our website with the effective date clearly noted. Continued use of the Product constitutes acceptance of the revised Terms.
